Refund policy
Everything sold here is a service. Nothing ships, so there is nothing to send back. This policy explains when you get money back and how much.
BEFORE WORK STARTS, NO QUESTIONS
If you tell me you want out before I start work on your project, I refund it in full. You do not have to give a reason, and I will not argue with you. This applies to every one-time product in the shop, including the Brand Builder. Email hello@topthreewebdesign.com or call or text (772) 999-1354.
ONCE WORK IS UNDERWAY
I refund whatever I have not yet earned. Work already delivered is not refundable: market research, a Market Positioning Summary, names presented, logo concepts sent, copy written, pages built, a Google Business Profile claimed and set up. I will send you a plain written list of what was done and what it accounted for, and refund the rest. If nothing has been delivered yet, that is a full refund. The sale is final once you approve the second round of revisions; if I send a written request for approval and do not hear back within ten business days, that round counts as approved.
PAYMENT PLANS
The Brand Builder is $4,500 and can be paid as $2,250 at checkout and $2,250 one month later. If you cancel before the second payment is taken, I cancel the scheduled payment and invoice only for the work delivered up to that point. Your deposit is applied against that work first. If the deposit exceeds what was delivered, the difference comes back to you.
MONTHLY PLANS
Care, Local Visibility, Growth and Authority are month to month. There is no contract, no cancellation fee and no notice period. You cancel from your own customer account, any month. Social media plans are invoiced, so you cancel those by telling me by email or text before your next invoice. The month you have already paid for runs to the end of its period and is not prorated. Canceling never takes anything away from you: the website, the domain, the Google Business Profile and every login stay yours.
WHAT DOES NOT COME BACK
Fees paid to third parties on your behalf are not mine to refund. That means domain registrations, Squarespace or hosting subscriptions, stock photography licenses, paid advertising spend and government filing fees. I will tell you before I spend any of your money on any of these.
BEFORE YOU FILE A CHARGEBACK
Contact me first. I have refunded people who simply changed their minds, and I would rather resolve it directly than through a card issuer, which takes weeks and tells neither of us anything useful.
HOW TO ASK FOR A REFUND
Email hello@topthreewebdesign.com or call or text (772) 999-1354, and say what you bought and when. Refunds go back to the original payment method. Card networks usually take five to ten business days to post it.
Top Three Web Design LLC, Sebastian, Florida.
Terms of service
These terms apply to everything bought from Top Three Web Design LLC, a Florida limited liability company based in Sebastian, Florida. In these terms "I" and "me" mean Top Three Web Design LLC, and "you" means the person or business buying. Buying anything on this site means you accept them. If they contradict a separate written agreement I have signed with you, the signed agreement wins.
WHAT YOU ARE BUYING
Services, not goods. Each product page states what is included, what is not included, how many revision rounds come with it and roughly how long it takes. That page is the scope. Anything outside it is new work, and I quote it before I do it rather than adding it to an invoice afterwards.
WHAT I NEED FROM YOU, AND WHEN THE CLOCK STARTS
Every build starts with an intake form. The delivery window quoted on the product page begins on the day the last required piece of intake arrives, not the day you pay. If information arrives in pieces or approvals sit unanswered, the schedule moves by the same amount. I will tell you the start date in writing once intake is complete.
Approvals are part of the work. Where a product page names an approval gate, nothing downstream of that gate gets built until you approve it.
APPROVALS, AND WHAT HAPPENS IF I DO NOT HEAR BACK
When I send you something to approve, tell me yes or tell me what to change. If I have heard nothing in ten business days after a written reminder, that item is treated as approved and I move on. This is not a trick to skip your feedback. It exists so a project cannot sit open forever with my time already spent.
If a project goes quiet for ninety days with no response from you, I will close it, invoice for the work delivered and hand over everything produced so far. You can restart later; the price and the schedule will be whatever they are then.
REVISIONS
Each product page states the revision rounds included, per deliverable. Anything I built wrong, a typo, a broken link or a mistake of mine is not a revision and is never charged. A change of direction after you approved something is new work, and I quote it before starting it.
THE MATERIAL YOU GIVE ME
You are responsible for what you send me. By sending photographs, logos, text, reviews, testimonials, customer names, prices, license numbers, certifications or claims about your business, you confirm that they are accurate and that you own them or have written permission to use them. That includes stock images, fonts and plugins you ask me to use.
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD ME HARMLESS FROM ANY CLAIM, LOSS, DAMAGE OR COST, INCLUDING REASONABLE ATTORNEYS' FEES, ARISING OUT OF MATERIAL YOU SUPPLIED OR INSTRUCTED ME TO USE, OR OUT OF A CLAIM YOU ASKED ME TO PUBLISH ABOUT YOUR BUSINESS.
I will flag anything that looks legally or factually risky, and I will not publish a claim I believe is false. That is a courtesy check, not a legal review, and it does not shift responsibility for your own material onto me.
WHAT I WARRANT
I warrant that I will perform the services in a professional and workmanlike manner, and that the work I create for you is original to me and, to the best of my knowledge, does not infringe anyone else's rights. If a claim is brought against you because of original work I created, I will defend it and cover it, provided you tell me promptly, let me control the defense and do not settle without my written agreement. That promise does not cover material you supplied, changes made after handoff, or third-party materials you chose.
THE DISCLAIMER OF EVERYTHING ELSE
EXCEPT AS STATED DIRECTLY ABOVE, THE SERVICES AND EVERYTHING DELIVERED ARE PROVIDED "AS IS" AND "AS AVAILABLE." I DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. I DO NOT WARRANT THAT A WEBSITE WILL BE UNINTERRUPTED, SECURE OR ERROR FREE, OR THAT ANY SEARCH RESULT, RANKING OR BUSINESS OUTCOME WILL BE ACHIEVED OR MAINTAINED.
NO GUARANTEE OF RESULTS
Search rankings, map pack positions, traffic, phone calls, leads and revenue depend on your market, your competitors, your reviews, your responsiveness and on Google, which changes without notice. I will tell you honestly what I expect and what I am seeing. I do not promise a position, a volume of calls or a result, and nothing on this site, in any proposal, or in any conversation should be read as promising one.
ACCESSIBILITY
I build with accessibility in mind: readable type, sensible contrast, alt text on the images I place, semantic headings and keyboard-reachable navigation. Unless a signed agreement says otherwise in writing, I do not certify conformance with WCAG at any level, I do not perform formal accessibility audits or assistive-technology testing, and I do not promise that a site meets the Americans with Disabilities Act or any other accessibility law. Accessibility is an ongoing obligation of whoever runs the site, and content added after handoff is yours. If you need a certified accessible build, say so before we start and I will price a specialist audit into the project or tell you honestly that you should hire someone who does that work.
WHAT YOU OWN
On final payment, the copyright in the deliverables made for you is assigned to you: the website code, the written copy, the logo files, the brand assets and the images I produced for you. It is an assignment, not a license. Your domain is registered in your name from day one and every login is handed to you in writing at launch. There is no fee to leave and nothing is held back to force a final payment.
What stays mine: my own templates, component libraries, code snippets, processes, checklists and the raw research behind a Market Positioning Summary. You get the conclusion and full rights to use it; the underlying working files and the method stay with me. Anything of mine embedded in your deliverable comes with a perpetual, irrevocable, worldwide license to keep using it as part of that deliverable. I may reuse my own underlying tools on other projects, and I will never reuse your name, your content, your brand or anything specific to you.
Concepts, drafts and directions you did not choose stay mine.
PORTFOLIO
I may show work I have done for you publicly, on this site, in case studies and on social media, including screenshots and before and after comparisons. Tell me in writing if you would rather I did not, and I will not.
CONFIDENTIALITY
Neither of us will share the other's non-public business information with anyone who does not need it to do this work, and each of us will protect it with at least the care we use for our own. This does not cover anything already public, anything either of us already knew, or anything a court or a law requires us to disclose. It lasts three years after the work ends. Your finished, published website is public by definition and is covered by the portfolio section above, not by this one.
THIRD PARTY SERVICES
Your site and listings depend on companies I do not control, including Squarespace, Netlify, Google, domain registrars, payment processors, email providers and any plugin or font vendor. Their pricing, outages, policy changes, account suspensions, deprecations and algorithm changes are not within my control and are not my responsibility. Any subscription in your name is yours to pay for, and I will tell you before any is started. Third-party materials come under their own licenses and those licenses bind you, not me.
NOT PROFESSIONAL ADVICE
I am not an attorney, an accountant or a licensed advisor of any kind. Business name checks against Sunbiz and the USPTO are a flag for you to follow up on, never a trademark clearance or a legal opinion. Anything I say about entity status, licensing, taxes, contracts, privacy law, accessibility law or compliance is a layman's observation. Get your own professional advice before you rely on it.
PAYMENT, LATE PAYMENT AND SUSPENSION
One-time products are paid at checkout unless a payment plan is offered on the product page. Monthly plans bill in advance and continue until you cancel from your customer account.
Invoices for work outside a product page are due fifteen days from the date sent. An invoice more than fifteen days late may carry a late fee of 1.5% per month on the unpaid balance, or the maximum the law allows if that is lower. If a payment fails or an invoice goes unpaid, I will contact you, and I may pause work until it clears. Time lost to a pause moves the schedule by the same amount.
Prices on the site are in US dollars and exclude any taxes that may apply.
REFUNDS
The refund policy is separate and forms part of these terms.
ENDING THE WORK
You can stop at any time. Tell me in writing and I will stop, invoice for what was delivered, hand over the work in progress and give you every login.
Either of us may end the engagement if the other is in material breach and has not fixed it within fifteen days of written notice. If I end it, I refund everything not yet earned and hand over whatever has been produced. I may end it immediately, without refunding work already delivered, if I am asked to publish something false, illegal or discriminatory, if you infringe someone's rights, or if the relationship becomes abusive.
Social media plans
My social media plans are Social Photos ($250 a month), Social Starter ($450 a month), Social Daily ($800 a month) and Social Daily Plus ($1,200 a month). Every plan starts with a one-time setup of $500, the same for every plan, paid at checkout in my shop.
Your monthly plan starts once setup is complete, and I invoice you for it then. After that, I invoice you each month, in advance. These invoices follow the payment terms in "Payment, late payment and suspension" above.
Every plan is month to month. There is no long-term contract and no fee to leave. You and I sign a short agreement at the start that covers the plan, the price and how either of us can end it. To cancel, tell me by email or text before your next invoice. The month you have already paid for runs to the end of its period and is not prorated. If you tell me you want out before I start work on your setup, I refund the $500 in full, as in "Before work starts, no questions" above.
You own your accounts and your content. Every profile stays in your name, with your login. You sign in to each account yourself on the scheduling tool's connect screen, and I never see or keep your password. If you cancel, everything posted stays on your accounts.
The music and design elements in the videos are licensed through my design software for use in your posts. That license covers the posts I make for you, on your accounts. It does not let you use the music or the design elements on their own, in other videos or anywhere else.
I make no promises on followers, views, likes, calls, leads or rankings. Those depend on your market, your customers and the platforms, and nothing on my site or in a conversation should be read as promising one. What I promise is the work: the posts, made, scheduled and checked the way my plan descriptions say.
Facebook, Instagram, Threads, TikTok, YouTube, X, Google Business Profile and the scheduling tool I use are companies I do not control. When one of them changes its rules, its features or what a scheduling tool is allowed to send, or suspends or limits an account, that is not within my control and is not my responsibility. If a change means a post can't go out the way your plan describes, I tell you, and you and I agree on the closest thing that can.
My total liability for anything connected to a social media plan is limited to the amount you actually paid me for that plan, as in "Limitation of liability" below.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, MY TOTAL LIABILITY FOR ALL CLAIMS CONNECTED TO THE SERVICES, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY, IS LIMITED IN THE AGGREGATE TO THE AMOUNT YOU ACTUALLY PAID ME FOR THE SERVICE THE CLAIM CONCERNS.
I AM NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST LEADS, LOST RANKINGS, LOST DATA, LOST GOODWILL, BUSINESS INTERRUPTION OR REPUTATIONAL HARM, EVEN IF I WAS TOLD THEY WERE POSSIBLE.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, INTENTIONAL MISCONDUCT, GROSS NEGLIGENCE, OR ANYTHING ELSE THAT CANNOT BE LIMITED BY LAW. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
Any claim connected to the services must be brought within one year of the date it arose, or the shortest period the law allows if that is longer.
BACKUPS AND SECURITY
I take reasonable care, but you are responsible for keeping your own copies of your content and for the security of the accounts and passwords handed to you at launch. Change them after handoff if you would like to. Share your logins at your own risk. I do not guarantee that any site, account or system is immune from unauthorized access.
HOW WE WORK TOGETHER
I am an independent contractor, not your employee, partner or joint venturer, and neither of us can bind the other. I may use subcontractors for parts of the work; I stay responsible for what they do. I work with other clients, including in your industry, and nothing here gives you exclusivity. While we are working together and for six months after, neither of us will directly recruit the other's staff or subcontractors without the other's written agreement.
You may not transfer these terms to someone else without my written agreement. I may transfer them if my business is sold or reorganized.
NOTICES
Written notice means email. Mine is hello@topthreewebdesign.com. Yours is the email address on your order. A notice counts as given on the day it is sent, unless it bounces.
THINGS OUTSIDE ANYONE'S CONTROL
Neither of us is responsible for a delay or failure caused by something we cannot reasonably control, including illness, death in the family, natural disaster, hurricane, fire, flood, power or internet failure, war, civil unrest, government action, or the failure of a third-party platform. The affected side tells the other as soon as it can, and the schedule moves. If it lasts more than sixty days, either of us may end the engagement, and I refund anything not yet earned.
GOVERNING LAW AND DISPUTES
These terms are governed by the law of the State of Florida, without regard to conflict of law rules. Before either of us files anything, we agree to spend thirty days trying to resolve it directly, in writing. Any dispute that survives that is brought in the state or federal courts serving Indian River County, Florida, and we both consent to that venue. In any proceeding to enforce these terms, the party that prevails is entitled to recover its reasonable attorneys' fees and costs from the other.
THE USUAL FINE PRINT, IN PLAIN WORDS
If any part of these terms is held unenforceable, that part is cut back only as far as needed and the rest stays in force. If either of us lets something slide once, that does not waive it for next time. These terms, the refund policy, the privacy policy and the product page you bought from are the whole agreement between us and replace anything said before. These terms were written by me without a lawyer, and they are not to be read against me simply because I wrote them. The sections on ownership, confidentiality, indemnity, disclaimers, limitation of liability, governing law and disputes survive the end of the engagement.
CHANGES
I may update these terms. The version in force for your purchase is the one published on this site on the day you bought. Changes are not retroactive.
CONTACT
Top Three Web Design LLC, Sebastian, Florida. hello@topthreewebdesign.com, (772) 999-1354.
Privacy policy
Top Three Web Design LLC, Sebastian, Florida, runs this site. This explains what I collect, why, and what I do not do with it.
WHAT I COLLECT
When you fill in a form or email me: your name, email address, phone number, business name and whatever you choose to write.
When you buy something: your name, email, billing address and what you ordered. Card numbers go straight to the payment processor. I never see or store them.
When you become a client: the business information you send me during intake, and the account logins you choose to share so I can do the work.
Automatically, when you visit: your IP address, browser and device type, the pages you look at and where you arrived from. This comes from Squarespace's built in analytics and from Google Analytics and Google Search Console.
WHY
To answer you, to deliver what you bought, to send the receipt, to keep records I am required to keep, and to understand which pages are working. That is the whole list.
WHO ELSE TOUCHES IT
Squarespace hosts this site and processes orders. Stripe and PayPal process payments. Google provides analytics and Search Console. Email is handled by my mail provider. Each has its own privacy policy and handles data under its own terms.
WHAT I DO NOT DO
I do not sell your information. I do not rent or trade it. I do not share it with advertisers or data brokers. I do not add you to a mailing list because you filled in a contact form. I run no advertising on this site.
If a client sends me their customer information to put on a website, I use it only for that job and I do not keep it afterwards beyond the project files.
COOKIES
Squarespace sets cookies needed to run the site and the cart, and analytics cookies that count visits. You can block cookies in your browser; the site still works, the cart may not.
HOW LONG I KEEP IT
Inquiries: until they are clearly dead, then deleted. Orders and invoices: as long as tax and accounting rules require. Client project files: for the life of the relationship and a reasonable period after, so I can help you if something breaks.
CLIENT LOGINS
If you give me access to your domain registrar, hosting, website or Google Business Profile, I use it only for the work you asked for. At handoff I put every login in writing and give it to you. Change the passwords afterwards if you would like to; I will not be offended.
YOUR CHOICES
Email hello@topthreewebdesign.com and ask what I hold about you, ask me to correct it, or ask me to delete it. I will do it, subject to records I am legally required to keep. There is no form and no fee.
CHILDREN
This site is for businesses. It is not directed at anyone under 13 and I do not knowingly collect information from children.
SECURITY
I take reasonable care with what I hold. No system is perfectly secure, and I will not pretend otherwise. If something happens that affects your information, I will tell you.
CHANGES
If this policy changes, the new version is posted here with a new date.
